Overview
VisioEngine ("we", "us", "our") operates the platform at visioengine.com and related subdomains (together, the "Service"). We respect your privacy and are committed to protecting the personal information you share with us, especially the photo you upload to generate your film. This policy explains what we collect, why we collect it, the legal basis we rely on, and the choices you have — including how to delete your data.
Information we collect
- Account information — your email address and display name when you create an account, and any profile details you choose to add.
- Wish text and prompts — the wishes you type and the refined prompts our engine generates, stored so you can revisit your library and so we can improve output quality.
- Photos and biometric data — the reference photo you upload contains your facial image, which we process to place your likeness into a generated scene. Depending on your location, this may be treated as biometric or special-category personal data under laws such as the EU/UK GDPR and the Illinois Biometric Information Privacy Act (BIPA). See "Biometric data and consent" below for how we handle this specifically.
- Generated scenes — the images and short films produced from your wish and photo.
- Usage and device data — basic analytics such as pages visited and approximate location, collected to keep the Service reliable and secure.
- Payment information — handled directly by Stripe, our payment processor. We never receive or store your full card details.
Biometric data and consent
Because your uploaded photo is used to place your specific likeness into a generated scene, we treat it as biometric data and apply extra safeguards:
- Consent. By using the Service and uploading a photo, you agree to this policy and consent to our processing of your facial image for the specific purpose of generating your film.
- Purpose limitation. Your photo is used only to generate the film you requested. We do not use it for facial recognition of you elsewhere, do not match it against other users' photos, and do not use it to train models that serve other users.
- Withdrawing consent. You may withdraw consent at any time by deleting your photo and associated data (see "Data retention and deletion" below). Withdrawing consent does not affect the lawfulness of processing that already occurred.
- No involuntary secondary use. We will not repurpose your photo for marketing, advertising creative, or any use beyond generating your film and providing customer support, without separately asking you first.
Photos of other people (including gifts)
VisioEngine can be used to create a film as a gift for someone else, which means the photo you upload may not be your own. If you upload a photo of another person:
- You must have that person's permission. By uploading a photo, you confirm that either (a) it is a photo of you, or (b) you have the informed permission of the person in the photo to upload it and to have their likeness processed by VisioEngine to generate a film, and you are authorized to give that permission on their behalf for this purpose.
- We rely on your representation, not on independently verifying it. We do not independently confirm that a non-self photo was uploaded with permission. This means the responsibility for obtaining that permission sits with the person uploading the photo, as set out in our Terms of Service.
- The person in the photo has their own rights. If someone contacts us directly to say their photo was uploaded without their permission, we will remove the photo and associated generated content and may suspend the uploader's account while we look into it.
- Recipients of a gifted film. If you receive a film made from your photo as a gift, you can contact us at info@visioengine.com to request its removal, even if you didn't create the VisioEngine account yourself.
How we use your information
- To generate, store, and display your wishes, photos, and generated scenes.
- To authenticate your account and keep your library private to you.
- To improve the quality, safety, and faithfulness of generated scenes (using aggregated or de-identified signals where possible — not your raw photo, except to the extent required to actually generate your requested output).
- To detect and prevent abuse, fraud, and prohibited content (for example, screening for photos of minors or non-consenting third parties).
- To provide customer support when you contact us.
AI processing and sub-processors
Wishes, prompts, and photos are sent to our AI generation providers to produce your scene. These providers process data on our behalf under contractual terms that prohibit them from using your content to train or improve their own general-purpose models. A current list of categories of sub-processors (e.g., AI generation, hosting, payments, authentication) is available on request at info@visioengine.com.
International data transfer
VisioEngine is operated by a Hong Kong-based company. Depending on where you are located, your information — including your photo — may be transferred to and processed in other countries, including where our hosting, payment, and AI processing providers operate. Where required by law (for example, for users in the EEA or UK), we rely on appropriate safeguards such as standard contractual clauses or equivalent mechanisms with those providers. Data retention and deletion
- Active data. We retain your account information, wishes, photos, and generated scenes for as long as your account is active, so you can revisit your library.
- Self-service deletion. You can delete individual wishes, photos, and generated scenes from your library at any time. Deleting a photo removes it from active storage.
- Full account deletion. To request deletion of your account and all associated data, email info@visioengine.com. We will complete deletion within 30 days of a verified request, except where we are required to retain limited records for legal, safety, fraud-prevention, or dispute-resolution purposes — in which case we retain only what is necessary and for no longer than 90 days beyond that requirement unless a longer period is legally mandated.
- Automatic retention limit. Absent an account deletion request, we retain uploaded photos for no longer than 12 months of account inactivity, after which they are automatically deleted.
Sharing
We do not sell your personal information and do not share your photo publicly without your separate consent. We share data only with:
- Service providers who help us run the platform (hosting, authentication, payments, AI generation) under contractual confidentiality and data-processing terms.
- Authorities or third parties where required by law, to enforce our Terms, or to protect the safety of any person.
Security
We use reasonable technical and organizational measures to protect your data, including encrypted storage for uploads and access controls on administrative tools. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Your rights
Depending on where you live, you may have the right to:
- Access, correct, or export your personal information.
- Request deletion of your personal information, including your photo.
- Object to or restrict certain processing, including biometric processing.
- (California residents) Know what categories of personal information we collect and receive an assurance we do not sell or share it for cross-context behavioral advertising.
To exercise any of these rights, email info@visioengine.com. We will respond within the timeframe required by applicable law.
Children
The Service is not directed to children under 18, and we do not knowingly collect personal information — including photos — from anyone under 18. If you believe a child has provided us information, contact us and we will delete it promptly.
Changes to this policy
We may update this policy from time to time. We will update the date above and, for material changes — especially any change affecting how we use your photo or biometric data — provide advance notice in the Service or by email before the change takes effect.
